Motion for preliminary injunction to halt Greenbrier Resort auction filed

GREENBRIER COUNTY, W.Va. (WSAZ) – A motion for a temporary restraining order halting the auction of the Greenbrier Resort was filed Monday in Greenbrier County District Court.

The Greenbrier Hotel Corporation, which includes West Virginia Governor Jim Justice, is listed as a plaintiff in the motion to stop the auction scheduled for Aug. 27. The auction announcement for the luxury resort near White Sulphur Springs was made public in a legal notice earlier this month.

The auction was announced due to alleged unpaid debts from Justice’s company. According to the Associated Press, Greenbrier’s debts are between $25 million and $50 million.

According to the motion filed Monday, “the notice of the trust sale was factually deficient because it did not identify all three parties by name” … “and was issued without the required authority. Those involved in the transaction, including JPMorgan Chase – one of the world’s most sophisticated banks – did not obtain the consent of GHC’s board of directors or owners required to approve the trust deed securing a loan to then-GHC President James C. Justice III.”

The motion continues: “Defendants are seeking to foreclose on the trust deed despite lacking the legal standing to do so. The threatened sale would cause irreparable harm to plaintiffs. Greenbrier’s reputation and business would suffer. Local jobs would be lost. And the foundation of Greenbrier County’s economy would suffer damage that will be difficult or impossible to repair.”
